Bracewell works closely with employers to ensure compliance with the Uniformed Services Employment and Reemployment Rights Act (USERRA). We help clients draft and implement policies regarding employees’ active duty and Reserves military service, provide training to key personnel charged with managing associated employment-related concerns and advise clients on specific issues affecting the client and its employees, such as:

  • Leaves of absence;
  • Re-employment of an employee into the client’s workforce after military service;
  • Determining the appropriate reemployment position;
  • The provision of the proper pay rate and benefits upon reinstatement, and;
  • The proper treatment of health plan coverage and the provision of pension/retirement benefits.
