Trademark Prosecution

Bracewell’s trademark lawyers regularly handle every aspect of brand protection for our clients, including trademark clearance, prosecution, counseling, maintenance, policing and enforcement. With an expansive network of foreign associates, we assist our clients with the development and implementation of cost-effective brand protection strategies worldwide. We have marked experience in high-volume searching and clearance with quick turn around, as well as high-volume prosecution. We regularly review proposed new brands and advertising campaigns to ensure maximum protection against trademark infringement, false advertising, and similar claims. In addition, we have prepared handbooks and conducted training sessions for the marketing departments and in-house legal teams, which are used to ensure proper usage of company brands and trademarks.

Trademark Enforcement

Bracewell's attorneys protect a wide variety of our client's intellectual property assets, including trademark, trade dress and copyrights. We have represented clients in bench and jury trials in state and federal courts nationwide, from preliminary injunctions through trials and appeals (including to the U.S. Court of Appeals for the Federal Circuit). Our lawyers also have successfully represented clients in oppositions and cancellations before the U.S. Trademark Trial and Appeal Board, in international administrative bodies and courts, and in customs seizure matters. Outside the litigation arena, our attorneys help clients develop trademark enforcement programs, which focus on the identification and elimination of trademark infringement with a minimum of expense. In addition, we assist clients with designing programs to prevent counterfeiting and we have brought a number of successful seizure actions under both copyright and trademark law.

The Internet and Domain Names

We are well positioned to advise clients on cutting-edge Internet issues, whether they relate to domain names (including the forthcoming expansion of generic top-level domains), social media, keyword advertising, phishing, scraping, online scams, domaining, or cybersquatting. We represent the world's largest online retailer, and thus handle a wide variety of issues relating to trademarks, unfair competition, false advertising and copyright infringement on the Internet. We have filed numerous UDRP complaints on behalf of a range of companies and also have brought a number of actions under the Anti-cybersquatting Consumer Protection Act.

Corporate Audits and Due Diligence

Bracewell performs periodic IP portfolio audits to identify the costs and benefits of maintaining each intellectual property asset. We provide due diligence in support of acquisitions, divestitures, financings and other transactions involving businesses and intellectual property assets worldwide. When appropriate, we work with financial experts to develop detailed models for evaluating intellectual property assets in the context of risk management, transaction collateral, and supporting the asset value of securities offerings.

We structure, draft and negotiate complex joint ventures, strategic alliances, and joint marketing, and collaboration research agreements. We also protect clients’ intellectual property rights in trademark license agreements, development agreements, research agreements, confidentiality agreements, trade secret and know-how agreements, and employment and consulting agreements. We negotiate agreements covering all aspects of product distribution, including distributors, sales representatives, original equipment manufacturers (OEMs), value-added resellers (VARs), channel allies and franchises.
