Bracewell represents clients in product-liability cases ranging from large multiparty and multi-county litigation to single person injury tort claims.  We serve as regional counsel for manufacturers or insurers in connection with product liability mass tort claims that involve:

  • Chemical toxic exposure allegations involving substances such as asbestos, benzene, latex, lead, manganese and silica
  • Medical devices, including orthopedic devices to hospital equipment, as well as pharmaceuticals and breast implants
  • Consumer products such as recreational and outdoor power equipment
  • Industrial products and processes involving the energy, construction and building industries.

Our lawyers are skilled investigators, with the technical knowledge and operational insight that product liability litigation requires. We work closely with clients in advance of litigation to understand the products, issues and key in-house witnesses. For complex cases and multiple suits, we form a permanent team to handle the suit and use online technology to economically manage large dockets.

Chemical and pharmaceutical product liability defense are a particular strength. The firm represents an array of chemical companies and manufacturers in toxic exposure cases that involve a large number of plaintiffs and defendants. In such cases, we have a strong track record of obtaining non-suits and settlements for very minimal amounts. We have handled cases involving acrolein vapors, asbestos, benzene, lead paint, manganese and silica. We also have defended clients from claims attributed to the use of prescription and non-prescription drugs, including prednisone, methylprednisolone, phenylpropanolamine, phen-fen, and such brand name pharmaceuticals as Cotrim and Albuterol.

We have represented chemical companies, refineries and concrete companies in hundreds of general personal injury lawsuits arising out of exposures and incidents at plants and refineries. Our attorneys have also defended a major oil and gas exploration company in cases involving personal injuries occurring in the oil field. The firm has developed a rapid response team to be on site at a catastrophic event, such as a plant explosion or leak, in order to proactively manage potential claims.
