Bracewell's Energy Regulatory Group represents clients in all aspects of power generation and transmission regulation, licensing and ratemaking. With decades of experience practicing within and before state, federal and international energy regulatory agencies, our lawyers know how to make regulation work for and not against our clients’ interests.

The group's attorneys and non-attorney regulatory consultants, together with the firm's white-collar crime and regulatory investigations group, have experience in representing clients before the Department of Energy (DOE), Federal Energy Regulatory Commission (FERC), Commodity Futures Trading Commission (CFTC), Securities & Exchange Commission (SEC), Department of Justice (DOJ) and Federal Trade Commission (FTC) in regulation, compliance and enforcement cases. Our attorneys and consultants have practiced within and before federal and state energy regulatory and enforcement agencies for over 50 years. We defend energy companies and traders in civil and criminal investigations and litigation under the Natural Gas Act, Natural Gas Policy Act of 1978, Federal Power Act and Commodity Exchange Act, as well as under state competition and unfair business practices laws. Our lawyers regularly counsel energy companies in disputes involving oil, gas and power contracts and other agreements, rates and tariffs, and other marketing and trading issues.

Compliance Manuals, Training in Best Practices and Enforcement Matters

Bracewell specializes in working with electric and gas utility clients in developing best practices and implementing those practices through compliance and education programs. For scores of clients the firm has prepared compliance manuals and materials that address the requirements of all federal, state and tribal authorities. We provide periodic updates to these materials to assure that our clients are always current. Central to these representations we provide on-site or Internet training sessions for client employees regarding regulatory compliance and enforcement.

Energy Compliance Network

Bracewell administers the Energy Compliance Network (ECN). ECN is an ad hoc industry group that monitors energy compliance and enforcement matters at FERC, CFTC and the Public Utility Commission of Texas (PUCT). The group is comprised of corporations interested in compliance with energy trading requirements. Bracewell hosts periodic ECN meetings in its Washington, Houston and New York offices and arranges for speakers from government and industry to address the group on topical compliance and enforcement matters. We keep the group apprised of significant agency orders in the compliance and enforcement areas through a private extranet created for ECN members.
