Laura B. Herring
Laura Herring has significant jury trial and arbitration experience in commercial litigation, energy litigation and professional liability defense in state and federal courts. She also represents a broad range of clients in tort and breach of contract litigation, personal injury defense, trade secret litigation and disputes relating to covenants not to compete.
Laura has represented midstream companies in suits involving product sales agreements, processing, gathering and transportation of natural gas, crude oil and natural gas liquids.
Laura has represented a major U.S. electrical power company in litigation involving energy purchase and sales agreements, indemnity agreements and breach of warranty claims.
She has represented national accounting firms in lawsuits relating to audit, tax and consulting services involving allegations of negligence, negligent misrepresentation, securities violations, breach of implied warranty, RICO violations, breach of fiduciary duty, fraud and conspiracy. She has also represented accounting firms in disputes with former partners regarding covenants not to compete and retirement benefits.
She has represented employers in temporary restraining order and temporary injunction hearings in disputes with former employees involving trade secrets and covenants not to compete and has drafted contract provisions for employers to reflect current law regarding trade secrets and covenants not to compete.
Represented electrical power generator company in contract disputes with joint venture partners, suppliers and service providers.
Represented oil and gas services company in multiple lawsuits with former employees involving claims regarding covenants not to compete, trade secrets, slander and breach of contract.
Represented national accounting firm and audit partner in audit malpractice case filed in Harris County District Court involving claims by a shareholder of a client of the accounting firm; case was settled favorably for accounting firm prior to jury trial.
Represented national accounting firm in audit malpractice case in state court jury trial. The case was tried to verdict and resulted in a defense verdict and a take nothing judgment in favor of accounting firm.
Represented national accounting firm in covenant not to compete case where former employees sought declaratory judgment that covenant was unenforceable and employer sought to enforce the covenant; the covenant not to compete was found to be enforceable by the Texas Supreme Court; Mann Frankfort Stein & Lipp Advisors, Inc., et al v. Fielding, 289 S.W.2d 844 (Tex. 2009).
Obtained summary judgments in state court on behalf of national accounting firm in two audit malpractice cases involving claims of negligence and negligent misrepresentation; also obtained summary judgments on behalf of national accounting firm in cases involving tax malpractice and involving professional consulting services.
Represented international engineering firm in a state court jury trial involving tort, contract and alter ego claims. Case was tried to verdict in favor of engineering firm and judgment in favor of engineering firm was affirmed on appeal.
Represented gas pipeline company in jury trial involving claims of breach of gas processing agreement and fraud. Case was tried in state court and resulted in a defense jury verdict and take nothing judgment in favor of pipeline company; judgment in favor of pipeline company was affirmed on appeal.
Represented upstream company in personal injury case involving claims asserted under the Longshore and Harbor Workers' Compensation Act and Outer Continental Shelf Lands Act.
Represented mining company in toxic tort claims asserted by homeowners, residents, and former employees.
