Jeffrey L. Oldham
Jeff Oldham is an experienced appellate attorney who has presented oral argument in the U.S. Supreme Court, Texas Supreme Court, U.S. Courts of Appeals for the Fifth and Federal Circuits (among other federal appellate courts), and state courts of appeals throughout Texas. Jeff has experience in a wide variety of subject‐matter areas, with a particular emphasis on energy, complex commercial litigation, and intellectual property. He is Board Certified in Texas in Civil Appellate Law, and is a frequent speaker and writer about appellate issues. Jeff also regularly works with trial counsel to formulate pre-trial and trial strategy, write dispositive motions, prepare jury charges, preserve error at trial, and handle post-trial proceedings. Before entering private practice, Jeff served as a law clerk to Chief Justice William H. Rehnquist of the U.S. Supreme Court (2004-05) and to Judge J. Harvie Wilkinson of the U.S. Court of Appeals for the Fourth Circuit (2003-04). He also served as Counsel to the Attorney General in the U.S. Department of Justice (2005-06).
Represented a copper mining, smelting, and refining company in the U.S. Supreme Court in a post‐bankruptcy fee dispute with a law firm over the firm’s ability to recover in excess of $5 million in fees incurred in litigating the fee dispute; presented oral argument in the U.S. Supreme Court and prevailed in a June 2015 opinion.
Represented a military support contractor on appeal in the Ninth Circuit from an $80 million judgment based on claims stemming from the Iraq war, and obtained reversal of the entire judgment on personal jurisdictional grounds; also representing the company in appeals involving similar claims in other federal circuit and district courts.
Representing an energy company on appeal from a dispute over a gas project involving tens of millions of dollars in damages, and successfully defended in the Texas Supreme Court an actual damages award of approximately $40 million; currently pending on rehearing in the Texas Supreme Court.
Represented an offshore energy company on appeal in a dispute with its insurers regarding coverage of damages arising out of Hurricane Ike, and obtained reversal of an adverse ruling and had judgment rendered for the client.
Represented a major oil field services company on appeal in fracking-related lawsuit, and obtained affirmance of a take-nothing judgment for the client.
Represented a major online retailer sued for alleged patent infringement, and successfully defended (including in the Federal Circuit) a judgment finding no infringement and invalidating certain patent claims.
Represented a high-profile attorney on appeal in legal malpractice case, and successfully defended (including in the Texas Supreme Court) dismissal of the case.
Represented a major funeral home services company in an antitrust suit alleging damages in excess of $1 billion, and successfully defended on appeal the district court’s rulings denying class certification and dismissing most of the individual claims.
Represented a state windstorm insurer in mandamus proceeding involving disqualification of its trial counsel, and obtained reversal of the disqualification ruling.
Represented a plaintiff investor on appeal from a take-nothing summary judgment in an oil-and-gas dispute involving over $100 million, and obtained reversal of the dismissal ruling.
Successfully defended (including in the Federal Circuit) a dismissal of a patent-infringement suit arising out of tire pressure inflation technology.
Represented a trust company in the Texas Supreme Court in an appeal involving procedural post‐judgment issue; presented oral argument in the Texas Supreme Court.
Represented a transportation company in a commercial dispute against a competitor, including successfully defending on appeal the grant of a temporary injunction for the client.
Represented an attorney on appeal from a contempt proceeding in a high-profile case, and obtained reversal of the rulings and had all adverse findings against the client set aside.
Represented a major petrochemical company in a dispute over a transaction, and obtained and defended on appeal a breach of contract judgment; case remanded for re-trial on damages.
Represented a steel company in a negligence suit against a port services provider, and obtained a partial affirmance of judgment awarding more than $1 million in damages.
Represented a landowner in en banc Fifth Circuit proceeding arising out of a dispute with a railroad, and successfully challenged adverse dismissal ruling.
Represented an oil field supply company on appeal from a dispute over royalties under a license agreement, and successfully defended a judgment awarding $60 million in royalties.
Represented a sulfur and chemical company in the U.S. Supreme Court in an environmental case challenging the EPA’s authority under the Clean Air Act.
Represented an oil field services company in a patent infringement matter, and successfully defended in the Federal Circuit a preliminary injunction issued to the client.
Represented an energy services company on appeal in an employment and securities case, and obtained reversal of most of the damages awarded against the client.
Represented a drilling company on appeal in a mass torts case, and obtained affirmance of a judgment dismissing the case based on forum non conveniens.
Successfully defended on appeal a judgment of nearly $1 million under a guaranty agreement.
Represented city officials in the U.S. Supreme Court in successfully opposing a writ of certiorari in a qualified immunity case.
