Brad Benoit has fifteen years of experience as a trial lawyer.  Brad's practice focuses on complex commercial litigation. He has counseled and represented clients in diverse matters, including contractual disputes, business torts, energy-related litigation, and bankruptcy-related litigation.  He has represented corporations and individuals on a contingency fee basis in many contexts, including representation of litigation trusts in claims against former equity owners, directors and officers of insolvent entities. He has tried cases in federal court, state court, and arbitration, and he has argued multiple appeals.

Obtained $132.75 million judgment for an Arizona-based copper mining company against an Indian conglomerate for breach of asset purchase agreement

Representing a biotechnology company in patent infringement claims for DNA sequencing technology

Energy-Related Litigation
Obtained $44 million settlement of fraud claims on behalf of private equity owner of gas storage facilities against former owners.

Represented exploration and production company in $10 million arbitration dispute over day rate charges for deepwater drilling rig operating in Gulf of Mexico

Represented founders of joint venture developing oil fields in Russia in arbitration dispute regarding amounts owed after reaching payout status on investment

Bankruptcy-Related Litigation
Obtained favorable settlement on behalf of litigation trustee of Bruno’s Supermarkets, an Alabama-based grocery store chain, for fraudulent transfers, preferential transfers and breach of fiduciary duty

Obtained favorable settlement on behalf of litigation trustee of Buffets, Inc., a Minnesota-based restaurant chain, for fraudulent transfers, illegal dividends, and breach of fiduciary duty

Represented litigation trustee of Value City Holdings, Inc., an Ohio-based department store chain, for fraudulent transfers and breach of fiduciary duty
