Bracewell Receives Favorable Decision for Client in Case of Hourani vs. Mirtchev

HOUSTON — Bracewell & Giuliani LLP represented Dr. Alexander Mirtchev and Krull Corporation in Hourani vs. Mirtchev in the U.S. District Court for Washington, D.C.  The case resulted in Judge Thomas Hogan dismissing the Houranis’ civil action with prejudice on May 8.

In his ruling, Judge Hogan noted that “A plaintiff…may not plead facts in their amended complaints that contradict those in their original complaint….Given the number and nature of inconsistencies between the complaints, the Court finds Plaintiffs’ explanations difficult accept.”

The decision brings an end to a five-year battle and ensures that the allegations cannot be refiled.

“We are pleased with Judge Hogan’s decision to dismiss the Complaint, just as the Houranis' previous claims were dismissed in this Court and various jurisdictions around the world,” said Bracewell Partner Richard W. Beckler, who led the firm’s litigation team on behalf of Dr. Mirtchev.  “The judge's decision to dismiss the complaint with prejudice, thus preventing the Houranis from refiling their baseless claims, and the judge's recognition of the merits of our request for sanctions against the plaintiffs and their lawyers, should put an end to the misuse of our U.S. legal system to pursue inappropriate claims.”
